Privacy Policy

Effective date: October 2, 2026

9317-3425 Quebec Inc (operating as Incapitalus) ("we," "us," "our") operates https://www.incapitalus.com and provides digital agency, website and web application services (collectively, the "Services"). We are based in Québec, Canada, and we are committed to protecting the privacy of our clients and visitors, including those in Canada, Denmark, the European Union, and elsewhere. This policy explains what personal information we collect, how we use it, who we share it with, how we protect it, and the rights you have.

1. Information we collect

We collect:

  • Identity and contact information you provide: name, email address, phone number, business name, and mailing address.
  • Billing and transaction information related to client engagements: invoices, agreed amounts, payment status and e-Transfer references. New engagements may be paid by Interac e-Transfer through your banking institution or, where offered on the payment page, by card through Airwallex. Card information is entered directly into Airwallex’s secure payment interface; we do not store complete payment card numbers. Records of previous transactions may be retained for support, accounting and legal obligations.
  • Account information (for software users): login credentials and the content or settings you create within the product.
  • Usage and technical data: IP address, browser type, device information, pages visited, and interactions with our Services, collected through cookies and similar technologies.
  • Communications: messages you send us through forms, email, or support channels.
  • Website audit information: the website URL, the niche and market information you provide, accessible public webpage content, observed public site signals, and information about public comparable sites used in the report.
  • Sales partner applications: experience, languages, location, availability, professional profile links, sales examples, acknowledgements, and other information submitted to evaluate an independent partnership.

2. How we use your information

We use personal information to:

  • provide, operate, and improve our Services;
  • prepare and deliver website audits by reviewing accessible public content and, when reliable comparables are available, public comparable sites;
  • process payments and send invoices or receipts;
  • respond to inquiries and provide customer support;
  • evaluate, screen, contact, and retain records of applicants for independent sales partnerships;
  • send service-related and, where permitted, marketing communications (you can opt out at any time);
  • maintain security, prevent fraud, and comply with legal obligations.

3. Legal bases for processing (EU/EEA users)

Where the EU General Data Protection Regulation (GDPR) applies, including for users in Denmark and the EU/EEA, we process personal data on the basis of: performance of a contract (to deliver Services you purchase), your consent (e.g., for marketing), our legitimate interests (e.g., improving and securing our Services), and compliance with legal obligations.

4. How and with whom we share information

We do not sell your personal information. We share it only with:

  • Payments: new engagements are invoiced after the scope and total are confirmed. Your banking institution and the Interac network process e-Transfers under their own privacy policies. Where card payment is offered, Airwallex processes the card information through its secure payment interface under its own privacy policy. We receive the payment status and transaction reference needed to identify and verify the payment, without storing the complete card number. Providers involved in previous purchases or existing subscriptions may continue to process their billing data under the applicable agreements and their own privacy policies. Removing online checkout does not erase those records or cancel existing subscriptions.
  • Service providers who help us operate the Services (for example, website hosting, email delivery, and analytics providers), under agreements that require them to protect your information and use it only for the services they provide to us.
  • Legal and safety: when required by law, regulation, or legal process, or to protect our rights, our users, or the public.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this policy.

5. International transfers

We are located in Canada. If you access our Services from outside Canada, including Denmark and the European Union, your personal information may be transferred to and processed in Canada and in countries where our service providers operate. Where required, we rely on appropriate safeguards for such transfers (for example, contractual protections), and Canada's federal private-sector privacy law has been recognized by the European Commission as providing an adequate level of protection for personal data transferred for commercial activity.

6. How we protect your information

We use administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, use, or disclosure — including encryption in transit, access restricted on a need-to-know basis, and the use of reputable service providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Data retention

We keep personal information only as long as necessary for the purposes described in this policy, to comply with our legal and accounting obligations, and to resolve disputes, after which we delete or anonymize it.

Website audit orders and generated reports are normally retained for up to 90 days so the report can be delivered, reopened and supported, unless a longer period is required for legal, accounting, fraud-prevention, contractual or dispute-resolution obligations.

Unless a longer period is required for legal, contractual, or legitimate operational reasons, applications from independent sales partners who are not selected are normally retained for no more than 12 months.

8. Your rights

Depending on where you live, you may have the right to: access the personal information we hold about you; ask us to correct or update it; ask us to delete it; withdraw your consent; object to or restrict certain processing; and request a copy of your data in a portable format. Residents of Québec and Canada have rights under Québec's Law 25 and Canada's PIPEDA; residents of Denmark and the EU/EEA have rights under the GDPR. To exercise any right, contact us using the details below. You may also lodge a complaint with your local data protection authority.

9. Cookies and tracking

We use cookies and similar technologies to operate the site, remember preferences, measure traffic, and (where applicable) support advertising. Where required by law, we obtain your consent before using non-essential cookies. You can control cookies through your browser settings.

10. Children's privacy

Our Services are not directed to children under the age of majority in their jurisdiction, and we do not knowingly collect their personal information.

11. Changes to this policy

We may update this policy from time to time. We will post the updated version with a new effective date.
